"COMEDY SHORTCUTS"
ONLINE CONTEST OFFICIAL RULES
THE CONTEST: Visitors to [www.DotComedy.com] will have the opportunity to vote for their favorite finalist film in COMEDY SHORTCUTS, a diversity short film showcase co-sponsored by NBC Universal, Inc. (the "Contest"). The filmmaker of the Film that receives the greatest number of votes during the Voting Period will be deemed the winner and will receive a prize of [A One-year subscription to Baseline StudioSystem.com]. NBC Universal, Inc. reserves the right to award other prizes as well, based on criteria to be determined in its sole discretion.
ELIGIBILITY: Anyone, anywhere can vote. Voters can vote as many times as they wish, subject to the exceptions provided below. By voting in the Contest, voters are bound by and agree to these Official Rules.
VOTING PERIOD: BEGINNING [on/about Oct. 4,, 2007 at 12 noon PST] AND ENDING AT [October 31 at 12 noon PST] (the "Voting Period"), viewers will have the opportunity to vote for their favorite Film. Entries must be received during the Voting Period to be counted.
HOW TO VOTE: To vote, go to [DotComedy.com] and follow the voting instructions.
CONDITIONS FOR PARTICIPATION AND VALIDATION OF VOTES: Votes generated by a script, macro, robotic or other automated means will not be counted. USE OF COMPUTER PROGRAMS TO VOTE AND/OR OTHER AUTOMATIC VOTING METHODS (SUCH AS HACKS OR BOTS), REGARDLESS OF METHOD OF VOTING IS STRICTLY PROHIBITED. NBC Universal, Inc. ("Sponsor") reserves the right to disqualify, and block or discard any votes from any individual who votes by any kind of electronic, mechanical or other automated means or otherwise tampers with or hacks the voting process as determined by the Sponsor in its sole discretion. Sponsor also reserves the right, in its sole discretion, to cancel, modify or suspend portions of the Contest in the event of a computer virus, bugs, tampering, unauthorized intervention, fraud, technical or system failure or disruption, force majeure or any other causes which, in its sole opinion, corrupt the administration, security, fairness, integrity, or proper operation of the Contest. CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. THIS IS OUTLINED MORE CLEARLY BELOW. Sponsor is not responsible for late, lost and/or incomplete votes, which will not be counted.
PRIZE: Sponsor name a winning filmmaker of the Film based on the greatest number of eligible votes received during the Voting Period. In the event of a tie, the Sponsor shall decide, in its sole discretion, whether and/or how to resolve the tie. Sponsor may award the winning filmmaker of the Contest with one or more prizes. In addition, Sponsor may award other, additional awards and/or prizes to the filmmakers of other Films, whether or not based on the number of votes received, in its sole and complete discretion. All federal, state and local taxes are the sole responsibility of the winners of the prizes, and failure to pay any such taxes or other obligations shall result in forfeiture of the prize.
GENERAL CONDITIONS: By voting, individuals fully and unconditionally agree and accept to be bound by these complete Official Rules and the decisions of Sponsor, which shall be final. Sponsor has the right to modify these rules in its sole discretion.
Individuals vote at their own risk. Sponsor is not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incorrect, incomplete, ineligible or unintelligible votes; (ii) telephone, electronic, hardware, software program, network, Internet or computer failures or difficulties; (iii) errors in transmission; (iv) any condition caused by events beyond the control of Sponsor that may cause the Contest to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, use or misuse of a prize, or from participation in the Contest; or (vi) any printing or typographical error in any materials associated with these Official Rules or the Contest generally. Individuals voting will assume all liability for any injury or damages caused or claimed to be caused by their participation in the Contest and/or the acceptance and/or use of any prize, and release Sponsor and its respective officers, directors, employees, parents, subsidiaries and affiliates from any such liability. Sponsor and its respective officers, directors, employees, parents, subsidiaries and affiliates assume no responsibility for any injury or damage to participants or to any other person’s computer relating to or resulting from entering or downloading materials or software in connection with this Contest.
PLEASE NOTE THAT A HIGH VOLUME OF VOTES OR TECHNICAL DIFFICULTIES WITH THE SYSTEM MAY RESULT IN TEMPORARY INABILITY TO VOTE IN THE CONTEST OR MAY RESULT IN A DELAY IN THE PROCESSING OF VOTES SUCH THAT AN INDIVIDUAL’S VOTE(S) IS NOT RECEIVED IN TIME TO BE COUNTED. SPONSOR IS NOT RESPONSIBLE OR LIABLE SHOULD ANY VOTE NOT BE RECEIVED DUE TO SUCH DELAYS.
Sponsor may prohibit any individual from participating in the Contest, if at the sole discretion of Sponsor, such person shows a disregard for these Official Rules or acts (1) with an intent to annoy, abuse, threaten, or harass any other individual, Sponsor, or its agents or representatives; or (2) in any other disruptive manner.
In the event of a dispute as to the identity of an individual voting, the authorized account holder of the email address used to vote, if applicable, will be deemed to be the voter. "Authorized account holder" of an email address is defined as the natural person who is assigned to an email address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the voters, participants, or Sponsor, in connection with the Contest, shall be governed by and construed in accordance with the laws of New York without giving effect to any choice of law or conflict of law rules or provisions which would cause the application of the laws of any jurisdiction other than the State of New York. Sponsor’s decisions as to all matters related to the administration of Contest and selection of the winner(s) is final.
WINNER: The winner of the Contest will be announced on [DotComedy.com] on or about [11/2/07]
